Gail Dines #qanda

It was brought up on #qanda that suing the porn industry for domestic violence is the same as suing McDonald's for getting fat. Gail Dines brought up another analogy: suing a pharmaceutical company for making faulty aspirin. This is incorrect on so many levels (so is the McDonald's analogy, however).

1) The porn industry is a third party;
2) Faulty aspirin doesn't necessarily mean that there was any negligence;
3) She started her analogy by implying that the pharmaceutical company needs to be regulated. This would defeat her argument of suing the porn industry when they should be regulated (but almost make a closer analogy in terms needing to sue the government for lack or regulation, the government being the third party.
4) There was another reason, I forgot it.
5) Nope, still can't remember.
6) …

The McDonald's analogy is also incorrect as she directly bought the food from McDonald's. A more apt analogy (using McDonald's) would be her spouse continued to bring McDonald's home to eat. This, of course, is inaccurate as an analogy for different reasons, but it is at least accurate in regard to which party is to be sued.

Note: this is saying nothing about the validity of what she is arguing (of which I mostly disagree anyway) but has to do with how she argues, which is always terrible; reminds me of how the publishing industry tries to twist piracy into something evil.

I will take one crack at her argument though. For a feminist she seems rather defeatist with regard to sexuality (not the orientation, but probably that too). Apparently men can use sexuality as a form of power, or to show power, but women who do the same are only doing it for the money. W…T…F? I would hope women have more respect in their sexuality than only prostitution.

Okay, another dig. Her arguments against porn ignore gay pornography and the growth of women watching it. As Leslie Cannold brought up (and was coincidentally completely ignored) people don't buy pornography any more, so getting statistics from sales is inaccurate. With regard to gay pornography, who is the victim of gagging? Do they have pained posteriors I wonder? Does she know about female domination BDSM videos? There so many things that seem to allude consideration in her argument, yet all pornography gets branded as gagonmycock.com?

Okay, rant over. Leslie Cannold was good.

Patent Troll

There is something very wrong with IP law  when companies can set themselves with a team of lawyers, patent a whole heap of ideas and then sue many others for infringing on them. Now, these companies do not actually create anything themselves at all (and have no plans to), but they are suing others who are inventing and manufacturing the actual products. The purpose of all IP law is was to encourage creativity and innovation . These companies do the opposite. The patent system is a joke, and it started when the first allowed patents for things that didn’t exist. This was exacerbated by allowing patents for discoveries (not inventions). How can a patents system that, like copyright, was originally put forward as a method to encourage innovation actually encourage innovation when there are companies not inventing anything but suing those who do all through the power of the patent system? The patent system needs a drastic overhaul all over the world, it needs to be brought back to its roots.
